Bankruptcy Plus is is a flexible, fully integrated system designed for optimum data entry, reporting, and case management efficiency.
The program ensures data integrity and eliminates repetitive data entry by
allowing the user to enter information only once in any order, and linking related items such as property and creditors' claims.
Bankruptcy Plus does the sorting and calculations automatically. If you change an item, all
the forms that use that data are automatically updated.
In addition, you can easily toggle from one chapter to
another and just as easily convert a priority creditor to an unsecured
non-priority creditor without losing the data entered. The
programs Archive and Restore functions allow the user to transport data between home and office computers by archiving cases to a disk.
The data may also be e-mailed from one site to another as an attachment,
though this raises security issues that the user must address.
A questionnaire/work sheet can be printed from the program and given to the debtor to fill
in and return. We did find a significant formatting problem in the form,
but the questionnaire can be edited and customized.
Cases may be entered under Chapters 7, 11, 12, and 13 of the Bankruptcy Code. The Chapter chosen will
determine what information is required. Some input forms are available for all cases, such as Debtor Information.
However, commands such as a Chapter 12/13 Plan Calculator will only be available for a Chapter 12/13 case.
Bankruptcy Plus contains both the State and Federal exemption lists which is
useful in cases where you wish to compare the relative advantages of each
exemption set for a particular client. In states where you may choose
between exemption sets, the exemption set does not need to be selected until the exemption schedules are ready to be printed. In states where only one exemption
set is available Bankruptcy Plus does not provide the choice.
The user can build a Common Creditor list containing names and addresses of creditors that appear frequently in
the bankruptcy cases you handle and select them when needed. Additional lists of other parties who require notice of a
bankruptcy can also be created. On-line help screens are available throughout the program, and provide context sensitive
information.
When the user files a Chapter 12 or 13 case, the
program provides fields for specifying when and how each class of creditors will be paid, provisions for payment of attorney fees,
and trustee fee calculation. The program can calculate the number of months for the plan, the amount of monthly payment required,
or the percentage to be paid to the general unsecured creditors, based on the
information entered.
Bankruptcy Plus contains a suite of forms required for filing petitions, as well as for post-petition notices,
motions, and orders. It also provides forms for use in cases where the attorney is representing a party other than the debtor,
such as an involuntary petition, proof of claim, and other motions and orders.
The forms that can be printed using Bankruptcy Plus are organized into forms packages, which are
groupings of forms. The user can arrange the forms into his own groupings to create a customized forms package.
All the forms in a package can be printed at one time, or one or more forms can be selected individually for
printing. Forms may be previewed on the screen and/or printed to a printer.
Most of the forms can be edited or printed in the built-in word processor.
The matrixes can be configured for output to a disk file, as required in some districts.
The user can also print the forms to a PDF file for electronic filing
if he also has Adobe Acrobat installed on his computer. According
to Cornerstone, Attorneys practicing in courts offering the CM/ECF system are able to file bankruptcy documents directly
with the court over the internet. The CM/ECF system accepts a Case Upload file that enables the attorney
to skip several case input web pages that are required before submitting the case files.
This feature was never tested by Alphasites, Inc., though it certainly should
prove to be a useful, if not indispensable feature in the future.
Bankruptcy Plus will run operate under Microsoft Windows for Workgroups, Novell Netware, and other
Windows compatible networks. The user can install both the program and the data on
their network server, or install the program on each workstation and share only the data on the server.
Overall, our tester found this program to
be excellent.
